Welcome to Is My Community. By accessing or using our website and services, you agree to be bound by these Terms of Service. If you do not agree, please do not use the site.
Description of Service
Is My Community provides a local community platform where users can view and post events, businesses, marketplace listings, and group content; create and manage profiles; and interact with other members. Content and images may be uploaded by users and displayed according to the features and visibility options you choose.
Eligibility and Account
You must be at least 13 years old to use this service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information and update it as needed. We may suspend or terminate accounts that violate these terms or for other reasons at our discretion.
User Content and Conduct
You retain ownership of content you upload (including text, images, and other materials). By posting content, you grant us a non-exclusive, royalty-free, worldwide license to use, store, display, and distribute that content in connection with operating and promoting the service.
You agree that you will not:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or that infringes another's intellectual property or privacy rights.
- Upload images or content that you do not have the right to use or that depict others without their consent where required.
- Impersonate any person or entity or misrepresent your affiliation.
- Spam, scrape, or use automated means to access the service without permission.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Interfere with or disrupt the service or others' use of it.
We may remove or restrict content that we determine violates these terms or is otherwise objectionable, and we may take action against accounts accordingly. We do not have an obligation to monitor all content but may do so.
User-Uploaded Images and Content
Images and other content you upload may be visible to other users or the public depending on the feature (e.g., marketplace, events, groups, profile). You represent that you have the right to post such content and that it does not violate any law or third-party rights. We are not responsible for user-generated content and do not endorse it. If you believe content on the site infringes your rights, please contact us with details so we can consider appropriate action.
Disclaimer of Warranties
The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. Your use of the service and any content is at your own risk.
Limitation of Liability
To the fullest extent permitted by law, Is My Community and its operators, affiliates, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of the service or any content. Our total liability for any claims arising from or related to the service shall not exceed the amount you paid to us, if any, in the twelve months preceding the claim, or one hundred dollars (CAD $100), whichever is greater. Some jurisdictions do not allow certain limitations; in such cases, our liability will be limited to the maximum extent permitted by law.
Indemnification
You agree to indemnify and hold harmless Is My Community and its operators, affiliates, and their respective officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the service, your content, your violation of these terms, or your violation of any third-party rights.
Changes to the Service and Terms
We may modify the service or these terms at any time. We will post updated terms on this page and update the "Last updated" date. Material changes may be communicated via the service or by email where appropriate. Your continued use after changes constitutes acceptance of the new terms. If you do not agree, you must stop using the service.
General
These terms constitute the entire agreement between you and Is My Community regarding the service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These terms are governed by the laws of the province of British Columbia and the laws of Canada applicable therein, without regard to conflict of law principles.
